Planning White Paper - Legal considerations

In August the Government published Planning for the Future, a white paper and consultation on reform to the English planning system. We also saw simultaneous proposals for reform to data on land control, as well as changes to the standard method for assessing local housing need. More recently we have seen significant proposed changes to permitted development rights and use classes orders.

With the consultation period on the white paper now closed, a major bill on planning reform is expected in 2021. This will be a significant piece of legislation with wide implications, including: 

  • A new zonal land designation system with expansion of permission in principles
  • Replacement of S106 developer contributions and CIL schedules with a new single Infrastructure Levy
  • Local and national design codes, accompanied by a new focus on “beauty”
  • Technology and digital upgrades for LPAs
  • Abolition of Duty to Cooperate and uncertainty about the future direction of regional planning
