Trudi Elliott, Chief Executive of the RTPI, appeared on Radio 4's flagship consumer programme, You and Yours, earlier today to discuss the Government's proposals to shorten the time allowed to lodge a Judicial Review.
Trudi Elliott emphasised the RTPI's key points on Judicial Review:
- that of the 11,000 Judicial Reviews, under 200 are related to planning issues
- the average length of time it takes to complete a Judicial Review is 10 months and shortening the time allowed to lodge a Judicial Review will only speed up the process slightly.
- The Government should consider using specialist planning judges, offering to move planning cases outside London and the South East - which have many complex immigration Judicial Review cases - to less busy areas of the country, and adopting and sticking to a timetable for dealing with planning cases in the courts.
